01 Acceptance of Terms

By accessing or using any service, website, or digital product provided by Akira Digital (“Akira Digital”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions. This includes our website at akiradigital.co.za and any associated applications or platforms.

If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Akira Digital.

02 Services Offered

Akira Digital provides a range of digital marketing and technology services, including but not limited to:

  • Web Design and Development: Creation and maintenance of websites and landing pages for small businesses.
  • Social Media Management: Content strategy, scheduling, and account management across social platforms.
  • Google Ads Management: Setup, optimisation, and management of paid advertising campaigns.
  • Search Engine Optimisation (SEO): On-page and off-page optimisation to improve organic search visibility.
  • Lead Generation: Digital strategies designed to attract and convert prospective customers.
  • AI-Powered Marketing Tools: Access to MARKA and other software tools offered under the Akira Digital brand.

The specific scope of services will be outlined in a proposal, service agreement, or subscription plan at the time of engagement.

03 Eligibility

Our services are available to individuals and businesses who are at least 18 years of age and are legally capable of entering into binding contracts under applicable South African law. By using our services, you confirm that you meet these requirements.

04 Payments & Fees

All fees for services are outlined in your agreed proposal, invoice, or subscription plan. Payments are processed through PayFast, a secure South African payment gateway. By making a payment, you agree to PayFast’s terms of service in addition to these terms.

  • All prices are quoted in South African Rand (ZAR) unless otherwise stated.
  • Payments are due on the date specified on the invoice or at the time of subscription.
  • Late payments may result in suspension of services.
  • We reserve the right to adjust pricing with reasonable notice.
  • Project-based work may require a deposit before work commences.

All online transactions are secured and processed by PayFast. Akira Digital does not store your card or banking details.

05 Refund Policy

We are committed to delivering quality services. Our refund policy is as follows:

  • Digital products and software subscriptions: Due to the nature of digital goods, all sales are final. No refunds will be issued once access has been granted, unless a material technical fault is demonstrated.
  • Monthly retainer services: Retainer fees are non-refundable once a billing period has commenced. You may cancel future billing by providing written notice before your next renewal date.
  • Project-based services: Deposits are non-refundable. If a project is cancelled after work has begun, you will be invoiced for work completed up to the cancellation date.
  • Exceptional circumstances: Refund requests outside of the above policy will be considered on a case-by-case basis at our sole discretion.

To request a refund or raise a billing dispute, contact us at info@akiradigital.co.za within 7 days of the transaction date.

06 Subscriptions & Cancellations

Certain services, including MARKA and social media retainers, are offered on a recurring subscription basis.

  • Subscriptions renew automatically at the end of each billing cycle unless cancelled.
  • You may cancel your subscription at any time by contacting us in writing. Cancellations take effect at the end of the current billing period.
  • We reserve the right to suspend or terminate access to subscription services if payment is not received within 7 days of the due date.
  • Downgrading or upgrading a plan will take effect at the start of the next billing cycle.

07 Intellectual Property

All content, designs, code, copy, and materials created by Akira Digital remain the intellectual property of Akira Digital until full payment has been received, at which point ownership transfers to the client as agreed in writing.

  • You may not reproduce, resell, or distribute our proprietary tools (including MARKA) without written permission.
  • You retain ownership of all original content, logos, and brand assets you provide to us.
  • We reserve the right to feature completed client work in our portfolio unless you request otherwise in writing.

08 Acceptable Use

You agree not to use our services or platforms for any unlawful, harmful, or abusive purposes. Prohibited conduct includes:

  • Engaging in fraudulent activity or misrepresenting your identity or business.
  • Using our platforms to distribute spam, malware, or illegal content.
  • Attempting to reverse-engineer, copy, or exploit any of our proprietary software or tools.
  • Violating any applicable South African or international laws.

We reserve the right to terminate access for any user found to be in breach of these conditions, without refund.

09 Limitation of Liability

To the maximum extent permitted by law, Akira Digital shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including loss of business, revenue, or data.

Our total liability to you in connection with any services shall not exceed the total amount paid by you to Akira Digital in the three months preceding the claim.

We do not guarantee specific results from digital marketing campaigns, as outcomes are subject to market conditions, third-party platforms, and factors beyond our control.

10 Privacy

Your privacy matters to us. When you use our services, we collect and process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

We collect only information necessary to provide our services, process payments, and communicate with you. We do not sell your personal information to third parties. For full details, please refer to our Privacy Policy.

11 Changes to These Terms

Akira Digital reserves the right to update or amend these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services following any changes constitutes your acceptance of the revised terms.
